Jail terms for building bosses over death of teenage worker

A “protracted and complex” investigation into the death of a 15-year-old casual construction labourer has resulted in jail sentences for the builder who employed him, and the disqualified company manager who was supervising the project at the time.

Thousand Apologies ????

It's been a month since my last posting. Too busy with the BIGGEST gathering for the muslim brothers at KLIA SEPANG Quarters... I spend nearly 2 weeks with that event.. need time participate... Then I was in Jakarta the day the incident occurred.... a shame may ALLAH SAVE US ALL...

Then off to Pgudang training for MMHE Safety Promoters program... and today manage to have haf day off, tomorrow new group SHO in JB... hope to get update soon... TQ for the patience.

UK HSE - 1st Prosecution on new law

First corporate manslaughter prosecution under new law gets underway 18/06/2009



Boss Peter Eaton and his company, Cotswold Geotechnical Holdings Ltd, appeared before Stroud magistrates yesterday (17 June) to answer charges of unlawful killing of an employee by gross negligence – the first prosecution to be brought under 2007’s Corporate Manslaughter and Corporate Homicide Act. (Click here for our earlier report.)

The case was brought by the Crown Prosecution Service in relation to the death of geologist Alexander Wright in September last year. Mr Wright, 27, was gathering soil samples in a trench in Stroud when it collapsed in on him.

Peter Eaton, the sole director of Cotswold Geotechnical Holdings, and the company also face charges under sections 37 and 33 of the Health and Safety at Work, etc. Act 1974, respectively.

In court yesterday, the 60-year-old spoke only to give his name, address and occupation. No pleas were entered and the case was committed to Bristol Crown Court for a preliminary hearing on 23 June. No pleas will be entered on this date either – the judge will set out the timetable for the prosecution and defence to serve their respective cases, and set a date for a plea and case management hearing (PCMH hearing).

STEP 3 - OSH Management System

Currently the common OSH Management System in Malaysia comprise of the Malaysian Standard MS1722 & OHSAS 18000.

The MS1722 was develop base on ILO OSH Management System Guideline 2001 . The background of MS 1722 relates back to an older version of MS ???? OSH Management standard which I bought at SIRIM way back in the 90's. Anyway the guideline is call MS1722:Part 2:2003 and the specifications/requirements MS1722:Part1:2005 don't confuse yourself.

Writing the proposal to the management will require your expertise towards acceptance. Some of the critical points that employers will want to know may include the following

1. Costing (Consulting & Training)

Appointing a consultant is very subjective. Some SHO tell me consultant only direct them what should be done and how to do it?. The stakeholders should realize that the consultant role has been prescribe in their appointment... However some clients do ask what should be their professional code of ethics ...

I have tune myself to comply as mush as possible the IOSH Code of Conduct
0r the ASSE Code of Ethics

Well consultants are your reference point, they are required by the professional ethics to assist your towards the development process.... The actual work process of developing the system will be told in the future steps.... Sabarlah,

at the end of the day the client does most of the work. (Which actually is what they are supposed to do.... which in turn becomes the buy in process.... the OSHMS Development Committee is required to be very familiar with the system because they will be the future REFERENCE point by the whole organization

Now if you look at current trend the following costing can be considered:-

  1. SHO own time............... no additional cost by employer, except the SHO will require a lot of leeway to perform his other duties..the snag is when the Safety & Health Committee is non committal to the OSHMS development.......... the SHO is given no choice but to end up in CNP Syndrome (cut & paste). Its OK to do it but DO IT RIGHT.. they cal it EDITING ha ha ha
  2. Consultant fee comes in numerous option and sizes???? Mainly influenced by the clients. Their fees are daily rated and some with additional charges including mobilization cost. Due to steep competition (Some time due to under table???-MAsukkkkkkkkkkk) fees can be in lump sum, example 3 in 1 Package....

2. Timeline

Normally they want it done fast. Like ASAPPPPPPP which is impossible when the SHO is required to dveleop the system him/herself.... however the minimum period will depend on the actual day the entire system document is completed. This step is link to the Certification Body nominated and they will conduct an adequacy audit on the system documentation, and only then a System Implementation training is conducted for the stakeholders to execute the system and to generate sufficient records.... system outcome. In other words about 2.5 Months before. So imagine you need time to ensure the following process

a) Kick Off Meeting
b) Gap Analysis/Initial Review
c) Strategic Planning
d) Basic Training Requirement
e) Defining Risk Assessment Method
f) Review of (e) advice further
g) System Document Designing
h) System Document Development Training
i) System Document Review for Adequacy Audit
j) System Implementation Training
k) System Implementation Review(Internal Audit)
l) Certification Process

Sincerity (IKHLAS NIAT)

Today I learn that sincerity is a very difficult TASK to perform, especially when in the beginning you might have decided to do a deed without expecting anything in return except from GOD ALMIGHTY (ALLAH SWT)..... but in realty you expect a gesture of gratitude from others???.. but even worst you use the event for your worldly benefits.... conflict of interest.... which may not look unethical but actually morally despicable.....

And when the event effects my principles as a MUSLIM.... and to avoid SHUBAHAT & RIBA.. I have to stand firm and no compromise....

I have tendered my resignation as the IAEM ASIA Council Treasurer and Country Rep with immediate effect. I will still complete my commitment till end of this month and handover all responsibilities back to the ASIA Council for their further action.

I will continue to write this blog, and hope to get things gosing ASAP..

STEP 2 - Common Stages of OSHMS Development

Basically whenever an organization decides to implement OSHMS for whatever reason we need to consider that the main objective is to use the OSHMS development process and a "CHANGE MANAGEMENT" opportunity.

The immediate concern is to establish development rules. You may act as the inhouse OSH advisor or a OSH Consultant but then again, have you established your role? What is the management perception on your role? What is expected out of you. Set the ground rules right.

Normally before that happen you may need to "SELL OSHMS" to your employer or client. There is no one way to do it except by getting to know how your employer/client perception on OSH.
